Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you and Voluncheer (“we”, “us”, or “our”) governing your access to and use of voluncheer.app and related services (the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Voluncheer is a social platform for volunteers to log, share, and celebrate their volunteer work. Users can record volunteer activities, follow other members, and give and receive social recognition (such as “cheers” and comments) on shared activities. Partner organisations can verify that a logged activity took place using QR codes generated through the platform.
The Services are intended for users who are at least 18 years old. Persons under 18 are not permitted to use or register for the Services.
We may update these Terms from time to time. Continued use of the Services after an update means you accept the revised Terms.
1. Our services
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. If you access the Services from outside Australia, you do so on your own initiative and are responsible for compliance with local laws.
2. Intellectual property rights
Our intellectual property.We own or licence all intellectual property rights in the Services, including the source code, design, and branding (collectively, the “Content”), as well as our trademarks and logos (the “Marks”). The Content and Marks are provided “as is” for your personal, non-commercial use only.
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and to download or print a copy of any portion of the Content you have properly accessed, solely for personal, non-commercial use. No part of the Services, Content, or Marks may be copied, reproduced, republished, or otherwise exploited for any commercial purpose without our prior written permission.
Your contributions.When you log an activity, post a comment, upload a photo, or otherwise submit content through the Services (“Contributions”), you retain ownership of it. You grant us a licence to host, store, display, reformat, and distribute your Contributions as necessary to operate and improve the Services — for example, showing your activity in a follower’s feed. We do not sell your Contributions or use them for third-party advertising.
You are responsible for what you post. By submitting a Contribution, you confirm it is your own original work (or that you have the rights to share it), that it does not violate anyone’s rights, and that it complies with the Prohibited Activities section below. We may remove or edit any Contribution, and suspend or disable an account, if we reasonably believe it violates these Terms.
If you believe content on the Services infringes your copyright, please contact us using the details in section 13.
3. User representations
By using the Services, you represent and warrant that: (1) all registration information you submit is true, accurate, and current; (2) you will maintain the accuracy of that information; (3) you have the legal capacity to agree to these Terms; (4) you are at least 18 years old; (5) you will not access the Services through bots, scripts, or other automated means; and (6) your use of the Services complies with all applicable laws. If any information you provide is untrue or incomplete, we may suspend or terminate your account.
4. User registration
You may be required to register to use the Services. You are responsible for keeping your password confidential and for all activity that occurs under your account. We reserve the right to remove or change a username if we determine, in our discretion, that it is inappropriate, impersonating, or otherwise objectionable.
5. Prohibited activities
You agree not to use the Services for any purpose other than as intended. As a user, you agree not to:
- Post or transmit content that is illegal, harassing, hateful, defamatory, obscene, bullying, discriminatory, or threatening to any person or group.
- Impersonate another person or misrepresent your affiliation with an organisation.
- Harvest or otherwise collect information about other users (including email addresses) without their consent.
- Attempt to bypass any security or authentication measures on the Services.
- Use any automated system (bot, scraper, or similar) to access the Services, or attempt to reverse-engineer any part of it.
- Upload or transmit viruses, spam, or any other material that interferes with the Services or other users’ use of them.
- Log volunteer activities or verifications that did not genuinely take place, or otherwise misrepresent your volunteering record.
- Use the Services for any unauthorised commercial purpose.
6. User generated content
Activities, photos, comments, and other content you post may be viewed by other users of the Services, subject to your profile and activity privacy settings. We do not pre-screen Contributions, but we may remove or restrict any Contribution at our discretion — including content that is illegal, infringes someone else’s rights, or otherwise violates these Terms — and may suspend or terminate the account responsible.
8. Third-party websites and content
The Services may link to third-party websites or content that we do not own or control. We are not responsible for, and do not endorse, any third-party content, and your use of any linked site is at your own risk.
9. Services management
We reserve the right, but not the obligation, to monitor the Services for violations of these Terms, take appropriate legal action against anyone who violates them, and otherwise manage the Services to protect our rights and the experience of other users — including restricting or removing Contributions and disabling accounts.
10. Privacy policy
Please review our Privacy Policy, which explains how we collect and use your personal information and is incorporated into these Terms.
11. Copyright infringement
We respect the intellectual property rights of others. If you believe content on the Services infringes a copyright you own, please contact us at voluncheerapp@gmail.com with enough detail for us to locate and review the content in question.
12. Term and termination
These Terms remain in effect while you use the Services. We may suspend or terminate your account at our sole discretion, without notice, for any reason — including a breach of these Terms. You may also delete your account at any time from your account settings. If we terminate your account, you may not re-register using a different name or a fake identity.
13. Modifications and interruptions
We may change, update, or discontinue any part of the Services at any time without notice, and we are not liable for any downtime or interruption. We may also update these Terms from time to time; the “Last updated” date above will reflect the most recent revision, and your continued use of the Services after a change means you accept the updated Terms.

14. Governing law
These Terms are governed by the laws of Australia. If a dispute arises that cannot be resolved informally, it will be subject to the exclusive jurisdiction of the courts of Australia.
15. Disclaimer
The Services are provided on an “as is” and “as available” basis. We make no warranties, express or implied, about the accuracy or completeness of the Services’ content, and we are not responsible for any errors, interruptions, or content posted by other users.
16. Limitation of liability
To the fullest extent permitted by law, Voluncheer will not be liable for any indirect, incidental, or consequential damages arising from your use of the Services, including loss of data or content, even if we have been advised of the possibility of such damages.
17. Indemnification
You agree to indemnify us against any claims or losses arising from your Contributions, your use of the Services, or your breach of these Terms.
18. User data
We maintain data you provide to the Services for the purpose of operating them, and we perform routine backups. You are responsible for keeping your own copy of any information you consider important, as we are not liable for any loss or corruption of data.
19. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Voluncheer regarding the Services. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision will not be considered a waiver of that right.
7. Social logins
Our Services may let you register or log in using a third-party account (for example, Google). Where you do this, we receive certain profile information from that provider as described in our Privacy Policy. We are not responsible for that provider’s handling of your information.
